Relief to the Unemployed Citizens through Jobless Benefits

Congratulations! To the millions of Unemployed citizens whose jobless benefits expired in June 2010, now have the means to support them while they are looking for work.

Job search is a stressful experience in a tough economy with millions competing for fewer jobs in the job market.

The extension revival by the Democrats and two Republican Senators Olympia Snowe and Susan Collins is a saving grace for the Americans out of work and the slow economic recovery.

An estimated five million people is expected to be relieved through this measure for they will receive allowances up to 99 weeks averaging $309 a week.

The long fought legislation survived the filibuster threat despite the majority in the opposition along with a lone Democrat, Ben Nelson from Nebraska voting for it.

It appears that the newly sworn in West Virginia Democrat Senator Carte Goodwin’s vote was crucial to move forward for the final Senate approval.

The contentious issue was the $34 billion benefit extension cost being added to the $13 trillion national debt instead of being provided for with cuts in the $3.7 trillion federal budget.

Although, the national debt is a legitimate concern with a valid proposal for funding the legislation, the Republican Senators could have identified the reallocation from the $3.7 trillion federal budget if they were seriously committed in helping their unemployed constituents and the people across the nation.

However, it’s never too late to review the federal budget to eliminate wasteful spending and prioritize economic activities such as this legislation over less important or extravagant budget expenditures.

As stated earlier, job creation and sustenance is an immediate requirement and the unemployment benefit is a catalyst to stimulate consumer spending that would promote the retail industry and the small business sector, the two most significant bases contributing to the ripple effect on the manufacturing, wholesale and the service industry in the economic recession.

Expediting job growth in the retail industry and small businesses is vital for long-term economic progress.

The argument about the out-of-control spending is more appropriate in the alarming defense budget with no auditing or accountability factor. Moreover, the extraordinary investment has not delivered the desirable results thus far.

Ironically, the ‘deficit’ is not an issue in the bipartisan legislation to increase defense funding for the wars in Afghanistan, Iraq, Pakistan and Yemen including the U.S. military bases around the world.

Whereas in the economic aspect the mere existence has been challenging for many and with the opposition blocking funding to the struggling states, the current federal aid is a lifesaver besides being an economic stimulus.

Even if the economic prospect is downsized, any improvement in people’s daily life enables them to endure hardships without losing hope.

According to the latest reports, the unemployment rate in many states is on the decline.

Any attempts to jumpstart the economy would restore consumer as well as investor confidence.

Jobs, housing market and economy have a major impact on the electorate anytime more so in the election year.

“Health Care Nightmare,” – Minor conditions lead to major insurance costs

Ralf Burgert had no idea how costly toenail fungus could be.

The San Rafael resident got rid of the common infection by treating it with the prescription medication Lamsil. But he could not believe the reaction when he applied for a health insurance policy on the individual market a short time later.

Because of the toenail fungus, an insurer informed him, he would be in a higher-risk insurance pool with a 50 percent jump in premiums.

Consumer advocates say they are often perplexed by the minor health issues that can create serious problems for people seeking health insurance. Each company sets its own policies.

People have been rejected for such common conditions as acne and high blood pressure, said Judy Dugan, research director for Consumer Watchdog.

“If you are pregnant, (insurers) will run the other way screaming,” she added.

“They don’t want to insure a baby until they have looked it over to make sure it’s absolutely healthy.”

A Fremont doctor said she was shocked when one insurer rejected her application because of her eczema, seasonal allergies and a brief bout with viral meningitis, despite a full recovery.

At age 45, Angelique Green, chief medical officer of the Tri-City Health Center, considers herself very healthy, with low cholesterol. She has never smoked, and her hobby is hip-hop dancing.

“To say no to somebody and not even try to work with them, that’s just wrong,” she said.
“It was very frustrating.”

Consumer advocates say they want to make sure that insurance companies do not become more aggressive with denials or dramatically hike premiums for those with pre-existing conditions during the next four years.

“The insurers now compete based on their ability to deny (coverage) to anybody who might actually need care,” Wright said.

“That will change, but not in the near term, and that’s a problem we will have to reckon with.
“It’s particularly important to be vigilant between now and 2014,” he said.

“We would like to see that the regulators closely monitor the denial rates for pre-existing conditions and the reasons for the denials.”

Insurance industry representatives call such concerns misguided and say they do not expect any major changes in underwriting policies before 2014.

“We have a competitive market in California, so health plans want people to buy their coverage, and they will charge a competitive price,” said Patrick Johnston, president and CEO of the California Association of Health Plans.

He noted that the insurance industry generally supported eliminating medical underwriting and guaranteeing coverage to applicants, as long as the change came with a government mandate that most people buy insurance.

Pre-existing conditions are not an issue for the 21 million Californians who have group insurance, usually provided through employers, because group plans accept people regardless of their medical histories.

But they can be a big worry for the 2.5 million Californians who buy insurance on the individual market.

California and many other states will soon set up new high-risk pools for those who have found it difficult or impossible to obtain coverage.

California will receive $761 million to fund this new pool, a dramatic increase over the $33 million for the state’s existing high-risk pool. But this money will not cover everyone with pre-existing conditions, and some may find the still-to-be-determined premiums too costly.

As a result, many people with pre-existing conditions are expected to remain in the individual market during the next four years and experience frustrations as they attempt to find coverage, consumer advocates say.

Consumer advocates such as Wright say people with pre-existing health conditions often encounter serious problems in obtaining coverage that hopefully will be resolved in 2014.

“Many people find it bewildering that it’s exactly the people who need coverage who are the ones who cannot get it,”

As more and more people get denied for smaller and smaller medical problems, both the industry and individuals have figured out that this is not sustainable,” he said.

“The system is broken.”

Redwood City resident Terri Mullen agrees. When she experienced work-related stresses in 2008, her doctor suggested she see a therapist and try anti-anxiety medication. Little did she realize the problem this would cause.

When she later applied for an individual insurance plan, a firm told her she would be in a high-risk pool with much higher premiums because the therapy and medication were signs of a serious mental illness.

Now, she says, “I’m not stressed out anymore – I’m mad.’

As noted in the cited article, the victims’ experience is precisely the reason for the requirement on the health care reform to be effective immediately rather than in 2014.

Although, the health insurance industry like other Wall Street behemoths dictate their terms and conditions in every legislation to water down the impact, the legislators still hold the key to an effective and meaningful law on every national issue from financial, energy to health care bills.

It’s not surprising to note the insurance industry representatives’ emphasis on ‘the government mandate to buy insurance,’ to enable the industry compliance with respect to pre-existing conditions and coverage offer to applicants.

The problem lies with the insurance industry’s policy against the mandatory subscribers with pre-existing illnesses and affordability factor for comprehensive quality care even in 2014 and thereafter.

Meanwhile, the insurance industry is determined to continue the status quo with coverage denial and placing subscribers under high-risk pool for minor ailments between now and 2014.

Since it’s a life and death matter, those who are declined coverage by the insurers face the worst possible situations as there is no guarantee to their health care access until the health care legislation becomes the law in 2014.

Despite the expected federal funding increase to the states to address the high-risk pool, the amount projected as inadequate to cover the patients with pre-existing illnesses forcing them to deal with the escalating premium costs in the market for individual subscribers.

That’s why the ideal solution to all of these issues would be to amalgamate the existing federal programs such as Medicare, Medicaid, CHIP, VA, COBRA and establish a “Single Payer” system for a “Universal Health Care” made available now to save life.

Nations thrive with healthy population contributing to a productive and prosperous economy.

It’s never too late to enhance the health care law for health care is a necessity and not a privilege.

Extending Unemployment Benefits – House Bill Failed By Three Votes

Less than an hour ago, the House of Representatives’ concerted effort to revive the bill extending unemployment benefits to the millions of people representing the stars and stripes fell short by three votes in the two third majority requirement.

Yea – 261 votes. Democrats – 231 and Republican – 30.

Nay – 155 votes. Democrats – 15 and Republican – 139

Not clear on the remaining single nay vote.

Despite the citizens’ plea to Congress members to pass the bill through bipartisanship,

By revealing their deteriorating economic situation due to the weak job market, severe recession and the unemployment benefits expiration,

The ‘Nay’ Sayers on both sides rejected the public plight to allow politics prevail over people’s life.

Legislation failing by three votes that could have salvaged millions from becoming homeless is a tragedy and a sad day for democracy.

Regardless of the political differences, ignoring the harsh realities experienced by the people across the nation is incomprehensible and speaks volume about the individual priority.

Perhaps, the lawmakers possessing the power to improve lives have a legitimate explanation for their action depriving the American families, the means viz. unemployment benefits and tax breaks for small businesses to cope with the dire economic crisis.

Human nature is to protect, preserve and nurture life, not aid in their destruction.

Unfortunately, the current trend is ominously in favor of the latter.

Anything that is detrimental to human existence and life threatening has overwhelming support in the political and judicial system fomented by certain news media.

On the contrary, the bills pertaining to economic recovery and legal issues on life sustenance is defeated with no concern for the consequences.

The reasons behind such decisions are usually related to personal and political ideology.

When human beings have the power to help others in their suffering and they willfully act against their conscience, it is clear that they are guided by their illusion rather than intuition.

The real joy and success is measured by the selfless activities i.e. without any expectations in return for promoting progress among the less fortunate in the society.

Any work performed for greater good often accompanied by empathy makes life worth living.

Notwithstanding the eternal bliss –

For health, wealth and power are meaningless without inner peace and happiness.

Something that cannot be achieved by superficial sources in life.

It’s a sincere hope that the Congress members in the House and the Senate elected by the people to address their needs would reconcile the disagreements with the majority and collectively resolve the national crises hurting their constituents and the citizens at large.

Citizens Plea to the Senators on Jobless benefits and Health Bill

The unemployed citizens have presented their desperate situation with the hope of getting some help.

It’s not always easy to be open and upfront to the world about one’s life.

It requires honesty. Honesty demands courage.

The citizens’ message has adequate reasons and highly inspirational, apparently a prerequisite in approaching the elected officials for their votes on life and death matter such as jobs and health related bills.

A lawmaker’s constitutional duty to serve the citizens at all times more so during critical hour is portrayed as a favor or mercy towards their subjects by the authorities and certain news media.

If these messages do not change the ‘Nay’ votes to ‘Yea,’ votes, then ‘compassion,’ and ‘righteousness’ have lost their meaning.

Meanwhile, anyone who could assist these citizens to cope with the difficult circumstances would be not only saving lives but also providing the nation with additional taxpayers through their employment.

G-8 and G-20, 2010 Summit – Toronto, Canada

A warm welcome to the world leaders attending the back to back G-8 and G-20, 2010 summit in Toronto, Canada.

The G-8 summit held on Friday, June 25, 2010 appeared to focus on the common economic issues such as financial regulations, deficit reduction and economic aid to disadvantaged countries on the financial side.

International peace and security – the leaders’ discussions are expansive from Iran’s controversial nuclear program, disarmament of North Korea, war in Afghanistan, Pakistan including the tensions in the Middle East.

Also in the agenda is the African leaders outreach on economic progress.

Social issues are related to protecting women’s health viz. maternal well being and infant growth in the regions lacking in antenatal care.

It’s important to begin with the financial sector and the economy for this topic.

Congratulations! To President Barack Obama, Speaker Nancy Pelosi, Senate Majority leader Harry Reid and the Congress members for the bipartisan votes in the long overdue financial reform.

It’s a major milestone and a fresh beginning to avert future financial crisis responsible for the global economic meltdown with spiraling effects on the housing, credit and job market.

Other industrialized nations like Germany passed their financial regulation with a mandatory deficit reduction. The constitutional amendment by Germany to contain the deficit to 0.35 percent of GDP by 2016 provided the higher deficit not attributed to GDP decline is a trendsetter in curbing the economic recession.

Similarly, the United Kingdom, Japan and the hard hit economies with huge deficits are in the process of clamping down on the national debt through fiscal austerity and tax hikes.

Likewise, raising taxes on health and environmentally harmful sources is a place to start due to the dual cause. It would protect the people and the habitat while generating revenue to pay off the accumulated debt.

In the United States, the legislation aimed at economic revival and federal aid to the states for essential programs is challenged by the opposition minority based on their national debt concern.

It’s a legitimate reason but the disapproval is directed at the nerve center of the society.

There are ways to pay for these bills by reallocating the unutilized funds in defense spending and pet projects. Moreover, there cannot be anything significant than helping the workers survive and enable them to be gainfully employed yielding tax payments.

Ignoring citizens’ plight has much higher economic and political ramifications.

Therefore, the stimulus bills with guaranteed tax returns are the means to expedite economic recovery.

Since globalization is embraced as the twenty first century economic policy, the anomalies in the system beckon the world leaders’ attention.

There is an urgency to implement international labor and environmental laws binding on transnational corporations to safeguard the environment and the workers’ interest against exploitation, negligence including fair and equal compensation regardless of territories.

Even though, the child labor is banned in some developing nations, the practice is widespread in the desperate parts of the world often engaged by the established multinational companies from the industrialized nations.

Stringent strategies against financial investment firms’ speculative activities that led the Greece and the neighboring economies to the brink of collapse are quintessential in the sweeping financial overhaul.

Some have addressed the problem by enforcing strict rules on the ‘derivatives’ and hedge fund mismanagement in the financial reform. However, the global standard would strengthen the application.

Burma/Myanmar belongs to the league in brutality against its citizens by the military junta reportedly occupied with the nuclear activity.

Worldwide nuclear disarmament is the course to pursue for global peace.

In other humanitarian issues – whether it is women’s rights, social justice or dealing with hunger, poverty and disease, they are all related to the political power governing the nations.

United States, EU, United Nations, Arab countries and emerging economic powers have a decisive role in promoting democracy, peace, human rights, economic and social progress by remaining impartial and committed towards the noble mission.

Republican Senators kill the Jobless Benefit bill

On Thursday, June 24, 2010, the Republican Senators unanimously voted against the jobless benefit and job creation bill that could have not only averted millions of American families from becoming homeless but also enormously boosted the small business and medium corporations with the necessary tax breaks to prevent layoffs.

Although, it comes as no surprise given the GOP Senators track record on any legislation since 2009 that has been passed with predominantly Democrats votes,

This particular legislation was aimed at economic revival and providing relief to the long term unemployed workers laid off due to corporate downsizing in a bad economy.

The GOP members’ decision against the life saving and economic recovery bill has the following consequences.

According to the Senate Democrats:

“The demise of the bill means that unemployment benefits will phase out for more than 200,000 people a week.

Governors who had been counting on federal aid will now have to consider a fresh round of budget cuts, tax hikes and layoffs of state workers.

This is a bill that would remedy serious challenges that American families face as a result of this Great Recession,” said Max Baucus, D-Mont. the chief author of the bill.

This is a bill that works to build a stronger economy. This is a bill to put Americans back to work.”

Essentially, the Republican Nay Sayers have successfully exacerbated the joblessness, economic recession and contributed to the state workers massive retrenchment.

All under the pretext of reducing national deficit, when in fact their partisanship has escalated unemployment depriving the economy of taxpayers to reduce the national debt.

Such bizarre political pitch is a direct assault on the American taxpayers-cum-electorates’ intelligence, besides adding insult to their injury.

Their fiscal policy – “Penny wise and pound foolish,” has been a miserable failure thus far.

The Republican lawmakers’ sudden consciousness for fiscal responsibility has come ten years late.

Only had they been conservative with the wayward spending during the period they were in control of the executive and legislative branch by reining in on the Bush-Cheney Machiavellian economic and war policy that has led to the status quo worldwide, the current obstructionism is purely political than fiscal.

Again, the Republican members’ misplaced priority in their approval of illegal wars that has bankrupted the economy and claimed over million lives juxtaposed to them rejecting the job creation bills guaranteed to reverse unemployment and vastly improve American lives is oxymoron.

The voters attention towards GOP systemic sabotage of American living standards is imperative, especially in November 2010.

The recent polls revealing the GOP lead in spite of their strong opposition to American progress is indicative of the lack of public awareness and selective media false propaganda.

Not to mention the inherent dangers of electing the Republican candidates determined to erase the dwindling middle class with an utter disregard for the lower income families.

It’s time for every unemployed individual hurting from the severe job loss and economic crisis – the Republican administration’s legacy to American families, to rise to the occasion and demand that the Republican members in the Senate honor their constitutional oath to serve the American interest and not their specific political agenda.

The GOP Senators’ dismissal of the American families represented by their own base along with the independent voters speaks volume about their commitment to drive the once thriving nation to oblivion.

Unequivocally, they prevailed in the past decade leading the nation to the point of diminishing return.

American democracy taken for granted and the disturbing polls suggest the GOP political maneuvering to stay ahead by distortion, while their performance in the Senate has been detrimental to Americans across the political spectrum.

The 200,000 jobless benefit recipients denied survival means by GOP Senators should dissent the gridlock and insist they deliver the votes required in the jobless benefit extension and every other legislation.

Regardless, the people should rally behind the Democrats at the State and national level, for they are the only hope in alleviating the burden on the American workforce and taxpayers.

Please send your affordable donations to the Democratic Party – DNC, DCCC and DSCC in Washington D.C. and help them secure supermajority in both houses of Congress to set the great nation, the United States of America back in motion.

The grassroots movement can make it possible as witnessed in 2008.

All those individuals affected by the economy and struggling to make ends meet need to turn the tide by replacing the GOP Senate filibuster with Democrats active participation for personal and national good.

Complacency to GOP tradition – stall and kill the bill is equivalent to rendering democracy powerless.

Meanwhile, the Medicare bill delaying the proposed 21 percent cuts in payments to doctors until November 2010 was passed as a stopgap measure to rescue the senior citizens and the disabled patients.

The bipartisan agreement to increase payments to providers by 2.2 percent is a temporary aid to the Medicare program beneficiaries.

Nevertheless, the partial legislation is appreciative.

Needless to state that the unemployment benefits extension would have salvaged the approximately two million families declined help by killing this bill.

Politics discrediting and attempting to weaken the target using the suffering population as pawn is counterproductive.

As stated on numerous occasions, negative emotions hurt the ones harboring more than the ones it is aimed at.

Real intentions behind any destructive course become known for truth cannot be camouflaged.

Nation flourish on solidarity among the powerful with the power to improve lives not the contrary.

There appears to be a light at the end of the tunnel for the victims of the worst industrial and environmental disaster.

The energy company, BP’s agreement to compensate monetarily with $20 billion over three-year period for the Gulf Coast oil spill impact is a fair beginning.

It’s been set up without a cap and to be monitored by an independent administrator previously appointed to oversee the 9/11 families’ relief fund.

In fact, the urgency lies with the company’s daunting task to stop the gushing oil completely, otherwise ‘plug the hole.’

President Barack Obama’s initiative deserves credit for it enabled BP’s decision.

Now, it’s imperative not to proceed in the direction that has inherent risks with unsustainable loss of life and income to the communities along the coastal regions.

Abandoning offshore drilling in deep and shallow water is the ideal solution to prevent economic and environmental costs.

Some permanent damages to wild and marine life are incomparable for they exceed any likely benefits from oil exploration to attain energy independence, especially when there are absolute clean energy options available through solar, wind, hydropower, bio-fuel etc.

Similarly, the Bhopal victims’ plea for justice in the historic industrial negligence causing several thousand casualties and wreaking havoc in the surroundings with terminal illnesses, birth defects… making life impossible for the impoverished survivors exposed the long buried truth suspected in the failure to implicate the parent company, Union Carbide USA and its then CEO Mr. Warren Anderson.

As stated in the earlier blog post titled “Worst Industrial Catastrophe – Union Carbide / Dow Chemicals and Bhopal Victims of India,” published on June 12, 2010,

The deal between the parent company Union Carbide USA and the Indian government at the federal and state representation confirms the immunity granted to Union Carbide USA including the assurance to the then CEO’s safe departure prior to his arrival in India.

According to the latest reports, the US Envoy to India in 1984, Mr. Gordon Streeb, has come forward and disclosed the details in the agreement between the parent company Union Carbide USA and the Indian government at that time.

The international and Indian journalists, the primary witnesses at the site, corroborated the events leading to the unresolved dispute.

Further, the ex-CEO Mr. Warren Anderson concurred with the key elements in the Bhopal accident settlement during his recent interview.

Per the emerging reports, “the previous Indian government in a sweeping effort to westernize the status quo and transform the ‘socialist,’ economy to ‘capitalism,’ adopted appeasement strategies to lure foreign investments.

In that context, the Bhopal tragedy was an impediment to the measures due to the multinational corporation’s conspicuous mismanagement of the chemical plant.

Subsequently, the transaction materialized at the highest political and corporate level in the backdrop of the greatest industrial calamity.

Again, obstruction of justice through politics and prejudice is not territorial.

It’s an epidemic that has evolved into an unpleasant fact for the innocent deprived of free and fair judicial process.

Nevertheless, the incumbent Indian administration led by Prime Minister Manmohan Singh seemingly responding with the following appropriate actions:

A new institution called the “EGom,” – Empowered Group of Ministers have been designated with the responsibilities to address the Bhopal victims’ humanitarian needs by imposing a deadline i.e. June 24, 2010 to expedite the much awaited disaster aid.

Bhopal EGom”s Tall Order:

Work out enhanced compensation package for the survivors of the Bhopal gas explosion.

Provide relief and rehabilitation to the victims.

Determine ways to decontaminate the site not precluding soil and ground water testing to ensure safe living conditions.

Rigorous regulations on industrial mishaps with liabilities directly transferred to the corporations in violation.

Last but not the least, the Government contemplating Mr. Warren Anderson’s extradition request.

The diligence demonstrated by Prime Minister Manmohan Singh and the Congress Party Leader Sonia Gandhi is praiseworthy.

However, the challenge remains in implementing the executive order with none or minimal bureaucracy that often delays the anticipated results.

The victims have endured enormous suffering and any procrastination would exacerbate their plight.

Notwithstanding the government obligations since they are the fund recipient in the Bhopal dispute.

Regarding Mr. Warren Anderson’s extradition – considering the individual’s frail health and age (90+ years), a televised formal apology to the Bhopal victims would be morally and ethically sound, rather than subjecting the elderly defendant to legal proceedings.

Although, the affected citizens’ pain and agony over these years has been excruciating, their forgiveness of those incarcerated in the horrific incident could heal the ordeal experienced by them.

For human spirit is enriched through compassion.

It’s a long journey for the disaster victims in the east and the west, but there is hope with the leaderships on both sides striving hard to end the misery.

Worst Industrial Catastrophe – Union Carbide / Dow Chemicals and Bhopal Victims of India

On June 7, 2010, the verdict on the worst industrial gas leak in 1984, Bhopal, India was delivered by the state’s local court.

According to the several reports:

The ruling convicted the seven officials in senior management along with the employees of the former Union Carbide India Limited (UCIL), the then subsidiary of the Union Carbide, USA with CEO Warren Anderson at that time.

Conviction included two years jail sentence and Rupees 100,000($2,100, €1,800) in fine.

Understandably, the judgment aroused sentiments among the victims’ devastated families and the survivors.

The NGO’s and other organizations representing the victims welcomed the much awaited process brought to national and international attention after pursuing the legal course for more than twenty five years.

However, they expressed huge disappointment in the limited sentencing and the exemption to the then Parent Company, Union Carbide CEO Warren Anderson.

India’s request for the CEO’s extradition to face trial was rejected in June 2004 by the United States.

Mr. Warren Anderson was the CEO of Union Carbide U.S.A during the industrial disaster in 1984 and served the corporation until 1986.

Subsequently, Union Carbide in their statement delineated themselves from the gross industrial negligence that claimed scores of lives and continue to affect more, the living and the yet to be born evidenced in the birth defects as well as other illnesses diagnosed thus far.

Union Carbide U.S.A transferred all liabilities pertaining to Bhopal incident over to its then fully owned subsidiary Union Carbide India Limited, while accepting the revenues and profits from the offshore operation. Effectively reflected in the multinational corporation CEO’s income, stock options and bonuses.

Moreover, the facts supporting the systemic operational facility discrimination between the U.S site and the Bhopal plant was disregarded in the entire proceedings.

“Greenpeace asserts that as the Union Carbide CEO, Anderson knew about a 1982 safety audit of the Bhopal plant, which identified 30 major hazards and that they were not fixed in Bhopal but were fixed at the company’s identical plant in the US.

Union Carbide asserts that the Bhopal plant addressed all of the identified issues well before the December 1984 gas leak and that none of them had anything to do with the disaster.

Greenpeace claims that neglecting these hazards in Bhopal caused the explosion.

Others, such as the former police chief Swaraj Puri, who was injured in the Bhopal disaster, asserts that Mr. Anderson must have known about the danger of the plant because an employee had died there a year before the disaster.”

Unfortunately, for the survivors and the victims’ families, the issue is not restricted to the selective indictment or the mild sentencing on a monumental management failure;

It’s rather an uphill battle to investigate the matter because of the high profile corporate and political power implicated in the horrific crime, especially with more information presented through visual content in the Indian media that confirms,

The “most wanted” CEO, Warren Anderson escorted in an Indian state government vehicle for safe departure from the Indian shores upon being released on bail after his arrest in December 7, 1984.

Mr. Anderson noted as the “chief defendant” in the trial from the beginning was excluded in the recent hearing outcome.

Later, “the arrest warrant issued on July 31, 2009 by the Chief Judicial Magistrate, Prakash Mohan Tiwari, Bhopal, India rendered ineffective due to the U.S. declining the extradition treaty, citing a lack of evidence.”

It bears resemblance to the 9/11 tragedy when the terror mastermind, Osama Bin Laden’s family were reportedly allowed secure passage from the United States in 2001.

The dangers of politics and prejudice playing dominant role in the judicial system, often deprives the innocent from obtaining justice even in the democratic society.

Such obstruction of justice through political influence and camouflage from the top bottom makes a mockery of the judicial system in a democracy.

It’s increasingly prevalent in the trials that could potentially expose the authorities in bad light.

No political system is an exception to the concept.

Besides, the news corps media being the primary voice for democracy have a journalistic responsibility to decipher the intricacies behind the funds exchange between Union Carbide USA and the Indian government that received the disclosed $470 million compensation with or without any stipulation.

Although, the monetary compensation is not proportionate to the suffering and damages sustained by the victims,

It’s still important to ascertain the amount actually received (if any) by the affected individuals in the prolonged dispute and address the status quo adequately.

Setting the political priorities aside, the dire situation beckons the Indian and the U.S. entities to view the Bhopal victims’ plight as a humanitarian calamity and exemplify requiring transnational corporations to adhere to universal environmental and ethical standards in the globalization era.

Justice denied to the innocent is Justice betrayed. For actions and decisions by all are judged accordingly.

Bhopal victims deserve better considering the long ordeal endured by them.

Providing medical assistance, toxin free living conditions with continuous monitoring to eliminate the persisting health hazards are the minimal needs for survival.

Enforcing strict industrial safety codes and regulations would protect workers from serious occupational injuries.

In addition, imposing liability on the corporations regardless of statehood for human and environmental harm is necessary to prevent negligence and evading financial obligation.

Whether it is Bhopal, India or the Gulf Coast in the United States, the communities pay the price in the deadly chemical release and oil gusher.

Perhaps, the bilateral solution to the problem rests with the Indian and U.S authorities to do right by shifting the burden of proof from the victims to those connected to the horrendous casualty in the Bhopal gas explosion.

Environmental Disaster – Gulf Coast Oil Spill

Ever since the explosion at the oil rig in the Gulf of Mexico that initially claimed 11 lives, the avalanche of unmitigated losses has become the reality.

It is evident in the oil dripping Pelicans, dolphins and lifeless birds alongside the economically devastated fishermen, tourist industry and restaurateurs.

Approximately 1.6 million gallons of oil reportedly gushed from the spill that is yet to be completely contained.

Meanwhile, it has evolved into the economic and environmental disaster for the entire Gulf Coast threatening the inhabitants in the adjacent regions with oil plumes traced as farther in Florida.

Further, the BP oil company liable for the calamity has maintained that it could take until August 2010 to stop the leak in the face of extensive damages to the states near the Gulf Coast.

During the congressional hearing on the major environmental catastrophe, it was clear the BP executives including the federal regulators responsible for monitoring the risks failed in their assessment of the pervasive repercussions from the oceanic accident prior to issuing permits.

Like any other hearing, the company CEOs’ concern for the shareholders interest superseded national interest when they evaded the obvious questions leading to the cause and aftermath of the accident.

The disappointments following the oil spill is the BP’s unsuccessful action to block the leak and more disturbing is the legislators, especially Alaska’s Republican Senator Lisa Murkowski and others rejecting the Democrat Senator Bill Nelson’s bill to increase the cap for oil spill damages to $10 billion from $75 million,

Thereby, eliminating the possibility to hold BP accountable in the greatest man-made environmental destruction.

As it turns out, according to the NYT June 5, 2010 report – titled ‘Gulf Oil Spill’:

“The letter co-signed by Janet Napolitano, the director homeland security, said that federal agencies had already spent $93 million on the spill response, which BP is yet to reimburse.”

When the industry representatives in Congress are in the forefront protecting them from financial liabilities and diligently transferring the burden on the taxpayers,

Besides allowing the federal agency to issue more permits for offshore drilling continuation,

The combined power in Washington and Wall Street determination to ruin the habitat with unsustainable policies is conspicuous.

Not to mention their decisions adding insult to injury endured by ordinary citizens across the coastal region having a ripple effect overall.

The reason to proceed with shallow water or deep water offshore drilling is provided as the necessity to meet the enormous energy requirement in the United States.

With energy and environment directly linked to consumption and conservation, the pursuit of clean energy from natural sources – solar, wind, hydropower and bio-fuel comprise the absolute safe energy solution against the increasingly risky and hazardous resources viz. coal, oil and nuclear energy.

Now the argument is immediate availability of the latter and the projected longer duration to harness the former.

Even though the solar, wind, hydrothermal as well as bio-fuel technology is currently in use, the U.S. investment in these abundant sources is replaced by the energy industry preferred limited resources i.e. oil, coal and nuclear power.

The simple explanation for the less importance to plentiful alternatives over scarce energy resources – which has led to perpetual wars, nuclear proliferation and consequently standoff is profit driven strategy set by the OPEC, ONGC, Coal and Nuclear industry.

Anything that is freely accessible to a large extent with a higher possibility to trade within national and international territories i.e. solar, wind and hydrothermal projects are secondary choices due to the broadening energy supply capabilities inducing competition to the energy monopolies in the industry.

The recent mining accident in Virginia, oil spill in the Gulf Coast, civilian nuclear program used as a pretext for nuclear weapons –

The latest being Myanmar, the military junta is apparently involved in uranium enrichment for a nuclear warhead,

All of it underscore the urgency to adopt energy programs that are environmentally conducive.

In terms of curbing the extraordinary energy demand, the society consuming less and leaning towards environmentally healthy lifestyle is the viable remedy to the burgeoning energy shortage.

For example, California’s recent announcement to ban plastic bags throughout the state and,

Previously guiding the nation on stringent carbon emission standards through EPA regulation to avoid legislative rigmarole are the positive steps to energy saving and life enhancement on earth.

Concentrating on the green technology development to boost green jobs is a favorable short and long term economic and environment goals.

Again, divestment from the conventional minerals to natural elements is the ideal alternative to energy independence.

Unless vigorous investments are made in the solar, wind, hydrothermal, biodiesel etc.,

The world will never be ready to migrate from the life endangering fossil fuel and nuclear energy to the truly green energy production.

Planet sustenance is dependent upon the ecosystem optimized preservation that is violated through prevalent drilling and mining for oil, coal and uranium.

The limitless human wants and desires have contributed to the status quo –

A dire economy, prolonged wars, cataclysmic changes to the environment in the form of extreme drought, flood, tornadoes, hurricane and tsunamis…beyond human control.

It is made worse by the lack of recognition to rein in on the profit oriented energy opportunities depleting the earth’s resources with no regard for the present or the future.

If the energy industry giants conscientiously engage in the energy derivation from sun, wind, water and bio-fuel the demand and the affordability factor can be effectively addressed, particularly with the hydrosphere phenomena –

Oceans covering the two-thirds of the earth’s surface supplemented by sunshine and windy conditions in the equatorial zones.

Instead, polluting and contaminating the natural habitat through risky mechanisms is opted regardless of the carnage from it.

Notwithstanding, the democratic powers political appeasement of the “Petro-dictatorial” regimes merely to replenish the ever growing contemporaneous energy needs.

There are several ways to relieve the society from the energy deficiency.

Reducing the usage and maximizing the above outlined potentials is the origin to end the energy and environment crisis.

Manufacturing and distribution of eco-friendly products and services is an emerging trend but not popularized in practice.

The existing problems related to the economy, energy, environment and political issues are attributed to excess greed, self-interest and dominance ultimately affecting all.

Unfortunately, the political and economic powers resist the environmental dangers in the Gulf coast oil spill and a range of energy industry mishaps for they refuse to steer away from the traditional means irrespective of the tragic outcome.

Expecting different results from the same methods fits the fantasy than the fact.

The position on the ‘presumed’ job losses from these sectors as the justification to resume offshore drilling in spite of massive environmental harm does not bode well for it ignores the similar, if not severe economic experience by the local industries and residents affected in the oil soaked areas.

Moreover, the energy industry is being requested to retain the workforce and not abandon them by diverting to solar, wind, hydrothermal and bio-fuel sources that aptly qualify as –

“Clean energy substitutes.”

Collective reaction rather than actions is witnessed in the Gulf oil spill with BP not demonstrating the ability to terminate the leak altogether into the seventh week of the horrific incident, rendering the numerous livelihood and lives dispensable.

Monetary compensation to the victims and the states impacted by BP’s negligence is the least the oil company could offer in this instance.

Marine life has been significantly impaired creating an ecological imbalance reflective in the deteriorating food pyramid.

Offshore drilling moratorium is negated by simultaneous shallow water drilling permits despite no guarantee in the so-called ‘risk free’ process.

Conflicting preparations are detrimental to the planet, the natural habitat for all species.

Energy challenges in the modern era are best dealt with natural and holistic approach.

Gulf Coast oil spill is just the tip of the iceberg in the energy exploration.

Thailand’s Political Crisis and Peaceful Resolution

The Thai government’s political crackdown through military might against the Red-Shirt protesters representing the rural poor and the urban working class population is autocratic than democratic.

Thailand is a nation with a history of military coups and a constitutional monarchy as the ceremonial head of the state.

Accordingly, democracy finds itself between a rock and a hard place.

The National United Front of Democracy against Dictatorship aka UDD and their supporters known as the Red Shirts are the discontent mainstream population in the rural and urban areas of the country marginalized by the current government whose representatives are regarded the elitist least concerned about the populist plight.

Having experienced the effective economic policies that,

Reduced poverty by half within four years,

The country’s first universal health care program,

Education, energy and a controversial yet seemingly popular anti-drug campaign under the deposed Premier Thaksin Shinawatra, the political crisis has been looming since 2005.

Thai politics is complex with the military junta, judiciary, corporate interests, communications media including the news corps and the monarchy exerting authority in the so-called democracy.

In a nutshell, except for the people participating in the voting process, the power is shared among the entities in the hierarchy.

While modern democracy is accustomed to some communication media not barring certain print press positioning with the authority in power in the self-contradictory newscast of their political idols fitting the profile – ‘journalism gone awry,’

The deep-seated problem with Thai governance is the cart blanche military power in direct control of the political system as witnessed in the 2006 coup d’état and now in the political violence producing civilian casualties in the State Capital, Bangkok.

People protesting the economic disparity called for ceasefire against civilians and pleaded with the authorities to begin peaceful negotiations.

The Red-Shirt protesters demand the incumbent Premier Abhisit Vejjajiva’s resignation.

The P.M. is confirmed to have been sworn in December 2008, through political maneuvering by the judicial and the military power not excluding the bureaucrats pledged allegiance to royalty.

In addition, the demonstrators seek Parliament dissolution for new general election due to lack of representation in addressing the Main Street problems.

The government via military has declined the proposals and continue the use of live ammunition against dissenters to disperse the crowd and imposed state emergency in most parts of the country.

With the internal security act in effect, the government’s systemic abuse of power against the people cannot be disregarded.

There appears to be serious violation of democratic principles starting with the explicit control of the communication media preventing the information flow, the only resource available to the economically disadvantaged groups in the anti-government rally.

The government excessive force has been prevalent since the anticipated political uprising during the military rule between 2006 and 2007 leading to the appointment of the current Prime Minister Abhisit Vejjajiva until the present time.

If the government in power were to focus on alleviating the economic woes like poverty,
unemployment, wage discrimination, housing, maintaining the universal health care, clean and safe environment…the basic expectations from citizens across the socio-economic spectrum on which it’s dependent for electoral votes,

The clash between the political class and the poor working class in the rural-urban areas would be non-existent.

Besides, the privileged members exploring opportunities to gain or remain in power for self-interest instead of the public and national interest is often the cause for political turmoil with the anti-government sentiments at its peak.

The government’s failure to deal with the economic and social challenges contributes to the political instability eventually threatening national security.

In this particular instance, democracy is undermined by the Kingdom’s regent; the military empowered to execute policies against the electorates’ will.

Public disappointment in the political system run by the nexus organization is justified in a democracy.

Therefore, it’s obligatory on the Prime Minister Abhisit Vejjajiva to comply with the people’s request for troop withdrawal and refrain from shooting the civilians in public square.

Military role is honorable in national defense i.e. protecting citizens’ lives unlike the contrary.

At the same time, the Red Shirt protesters must leave the site and abandon activities endangering the public and the environment.

Based on the evidence in the ongoing political crisis,

The Premier had rejected peaceful negotiations with the representatives of the rural poor and working class population causing civilian deaths that could have been prevented in the prolonged political unrest.

Notwithstanding, the undemocratic events of the military coup and the Premier’s subsequent appointment expended in defending the right to remain in office rather than resolving the issues constructively in national interest,

The call for Prime Minister Abhisit Vejjajiva’s resignation is appropriate allowing democracy to prevail through free and fair elections where the candidates would represent the republic of Thailand with a sincere commitment to serve the constituents per “The 1997 People’s Constitution.”

Political decisions and appointments from 2006 until now, specifically the 2007 Constitution of Thailand established by the military junta is null and void.

Further, an independent inquiry to investigate the abuse of power resulting in political oppression and loss of human lives is recommended.

Sovereignty, eternal peace and prosperity is the inevitable outcome of the political resolution.
